TDS/PDS--D. Tender Preparation--

1. The bidder must submit a valid and up-to-date Trade License.
2. The bidder must submit a valid 13-digit Business Identification Number (BIN) Certificate.
3. A duly attested photocopy of the 12-digit e-TIN Certificate must be submitted.
4. A duly attested photocopy of the Income Tax Payment Certificate for the last fiscal year (2025–2026) must be submitted.
5. A duly attested photocopy of the bank statement covering transactions for the six (6) months preceding the publication of the tender notice must be submitted.
6. A duly attested photocopy of the Working Capital Certificate and Credit Commitment Certificate (for the amount specified in the TDS) issued by the bank must be submitted.
7. A photocopy of the National Identity Card (NID) must be submitted.
8. One recent passport-size photograph must be attached.
9. The bidder must possess a valid license issued by the Department of Explosives for the storage of filled LPG cylinders.
10. The bidder must be an authorized dealer of an LPG importing and supplying company approved by the Government of Bangladesh.
11. The successful bidder shall submit a Performance Security equivalent to ten percent (5%) of the contract value in the form of a Bank Draft, Pay Order, or Bank Guarantee.
12. The Procuring Entity reserves the right to terminate the contract at any time by serving one (1) month's prior notice.
13. The LPG price for the month of August shall be fixed in accordance with the circular issued by the Bangladesh Energy Regulatory Commission (BERC), Memo No. 28.01.0000.012.17.002.26.3096, dated 02 August 2026.
14. The supplier shall quote only the service charge and profit margin.
15. The quoted service charge and profit margin, excluding the LPG price fixed by BERC, shall remain fixed throughout the contract period. The monthly LPG price determined by BERC shall be added to the fixed service charge and profit margin, and payment shall be made accordingly.
16. Payment for LPG shall be made in accordance with the monthly price fixed by BERC.
17. Previous Experience: The bidder must have experience, within the last one (1) fiscal year, in supplying similar goods worth at least BDT 330,000 to any public university, specialized institution, or government hospital.
18. The quoted price shall not exceed the Official Cost Estimate. Any tender quotation exceeding the Official Cost Estimate shall be treated as non-responsive and rejected.
19. The supplier shall supply the required goods regularly on a monthly basis, as per demand, for at least the next one (1) year.
20. If the successful bidder fails to submit the Performance Security and execute the contract on a non-judicial stamp of BDT 300 within the stipulated time, or declines to execute the work order or supply the goods, the Earnest Money Deposit (EMD) shall be forfeited and the preliminary selection shall stand cancelled.
21. In the event of any issue not specifically covered by these tender terms and conditions, the decision of the Procuring Authority shall be final and binding. The Tender Committee shall not be bound to accept the lowest tender and reserves the right to accept or reject any or all tenders, in whole or in part, without assigning any reason.

22. If required, the bidder must produce the original certificates for verification upon request by the Procuring Authority.
23. If any audit objection arises during or after the contract period concerning the selected supplier/contractor, the supplier/contractor shall be solely responsible for taking all necessary measures to resolve such audit objection.
24. Each bidder must submit a declaration on its official letterhead stating that the company has not been blacklisted by any government organization or government hospital in Bangladesh.
25. Tender Submission Procedure: The tender must be submitted through the e-Tendering (e-GP) system.
26. Performance Security: The Performance Security shall be submitted through the e-Tendering (e-GP) process in accordance with the applicable rules.
27. VAT and Income Tax Deduction: VAT, income tax, and any other applicable taxes shall be deducted from the submitted bills in accordance with prevailing Government of Bangladesh rules and regulations.
28. The supplier shall deliver the goods strictly in accordance with the demand issued by the Procuring Authority. Payment shall be made only after the supplied goods have been duly received and accepted by the designated committee.
29. Under no circumstances shall the First Party be liable to pay for the value of empty LPG cylinders.
30. Upon receipt of a requisition, the supplier (Second Party) shall deliver the refilled LPG cylinders within twelve (12) hours to the designated locations, including the Ansar Camp (Former Betar Bhaban) and the Diet Department Kitchen.
31. After the refilled cylinders have been used, the supplier (Second Party) shall collect the empty cylinders at its own cost and responsibility. The end users shall hand over the empty cylinders to the supplier upon collection.
