1. As per TDS.
2. Moreover, The recent amendment of PPA, 2006 which is made vide Act no.37 of 2016 and published vide Bangladesh Gazettee registered no. D A-1 on 01.08.2016 ( 17 Srabon 1423) , of which according to the cluase no. 07 & sub-cluase no.03 "For Open Tender Method (OTM) for procurement of works Tenderer will be considered as non-responsive if the quated rate is 10% more or less than the official cost estimates". On the other hand according to sub-cluase no.04 of cluase no.07, "If the quated rate of all Tenderers are found equal, then reponsive Tendrer will be selected as per rule, but not through Lottery".
3. Payment will be made according to the avalibility of fund but the work must be completed within the given time period. Otherwise Liquidity damage may be imposed.
