Any tenderer(s) who fullfill the requirements stated in TDS. * The Tenderer with a poor performance, consistent history of litigation or arbitration awards against it shall not be eligible to tender. * During evaluation if the quoted rate by any tenderer is found more than 5(Five) percent less/above than the Official Estimated price, then it is mandatory to submit Rate Analysis when asked by the Procuring Entity and if the quoted rate by any tenderer is found more than 10(Ten) percent less/above than the Official Estimated price, then the respective tenderer will be revoked from the tender . * The Defects Liability Period is 180 Days * The Tenderer must provide following information occurred during the last five years with evidence in favor of submission along with the Tender [years counting backward from the date of publication of IFT in e-GP website]: - Detailed Litigation History which must include the number of court cases filed and won against different Procuring Entities (PE). - Detailed Debarring History (Debarred Years) by any PE. - Detailed information on termination of incomplete contract by any PE. - Detailed information on extension of time beyond original contract period by any PE. - Detailed information on imposition of Liquidity Damages (LD) by any PE. - Detailed information on extension of contracted Defects Liability Period (DLP) by any PE. - Detailed information on insolvency or bankruptcy. NB: 1. The Tenderer shall maintain highest ethics in providing information regarding the tender. 2. If corrupt, fraudulent, collusive, coercive or obstructive practices of any kind is determined against any Tenderer, then measures shall be taken as per ITT clause 4 of Standard Tender Document.
