Uncompleted contract Amount of the Terminated Contract but in no case it shall be less than minimum 10 (Ten)% of the Uncompleted Contract Amount. (ii) The Assessed Compensation as recommended by the Compensation Assessment Committee shall be recoverable as instructed in GCC clause 38. (iii) In case of failure to realize such Compensation by the contractor, the Procuring Entity/Project Manager shall take necessary measure to recover the same from any dues remained in his office (Such as Performance Security, Retention Money, Tender Security, Pending Bill of other contract etc). Furthermore if the total amount due to the Procuring Entity still exceeds any payment due to the Contractor, the difference shall be a debt payable to the Procuring Entity. (iv) The Procuring Entity/Project Manager shall however proceed to complete the remaining work engaging new contractor.

PCC--D. Cost Control--	The maximum amount of Liquidated Damages for the uncompleted Works or any part thereof is [insert percentage] percent of the final Contract price of the whole of the Works.
